Welcome to Rose-Luxe, your trusted boutique for authentic, pre-owned luxury goods. By making a purchase, you agree to the following terms:
1. Authenticity Guarantee
All items sold are guaranteed authentic. We do not deal in counterfeit goods. If any item is proven inauthentic, you will receive a full refund.
2. Condition of Products
Our items are pre-owned and may show minor signs of wear. Each product listing includes detailed descriptions and photos to help you make an informed purchase. We endeavor to include any and all imperfections in the product description and photos but at times not all possible imperfections due to use may be visible.
3. Payment
All prices are in USD. We accept major credit/debit cards, PayPal, and other methods listed at checkout. Payment must be made in full at the time of purchase.
4. Shipping & Delivery
Orders ship within 5 business days from Miami, Florida. We offer domestic and international shipping. Tracking details will be provided. Rose-Luxe is not responsible for delays caused by carriers or customs.
5. Returns & Refunds
All sales are final, unless the item is significantly not as described or found to be inauthentic. If eligible, returns must be requested within 3 days of delivery and returned within 7 days. Items must be in original condition with tags, packaging, and no additional wear.
6. Limitation of Liability
Rose-Luxe is not liable for indirect or consequential damages. Our total liability is limited to the purchase amount.
7. Privacy
We respect your privacy and process your data in accordance with our Privacy Policy.
8. Governing Law
These terms are governed by Florida law. Any disputes will be resolved in the courts of Miami-Dade County.
For Consignors – Consignment Agreement Summary
Rose-Luxe – Consignment Terms and Conditions
Effective Date: July 29, 2025
By consigning items with Rose-Luxe, you (“Consignor”) agree to the following terms:
1. Item Acceptance
Only authentic, high-quality, pre-owned luxury items will be accepted. Items must be clean, in good condition, and subject to approval by Rose-Luxe.
2. Pricing
Rose-Luxe will set a selling price based on market research and brand value. Prices may be adjusted after [30] days to improve sale potential, with or without prior notice.
3. Commission & Payout
Once sold, the Consignor receives 60% of the final sale price, less any processing or promotional fees. Payments are made monthly for items sold in the prior month.
4. Consignment Period
The standard consignment term is [90] days. Unsold items will be returned to the consignor or may be donated, as per prior agreement.
5. Loss or Damage
Rose-Luxe takes reasonable care of items but is not liable for loss or damage due to theft, fire, or other force majeure events. Insurance may be offered for high-value items upon request.
6. Authenticity
Consignors must guarantee that all submitted items are authentic. Any item found to be counterfeit will be returned or destroyed, and the consignor may be held responsible for any damages.
7. Governing Law
These terms are governed by Florida law, with disputes subject to the courts of Miami-Dade County.
CONSIGNMENT AGREEMENT
This Consignment Agreement (the “Agreement”) is made and entered into as of [Insert Date] _____________, by and between: Rose-Luxe Boutique, a business organized and operating in Miami, Florida, with its principal place of business at [ 8725 SW 178 Terrace, Palmetto Bay FL 33157 (the “Consignee”), and:

Collectively referred to as the “Parties”.
1. Purpose
Consignor desires to consign certain items to Consignee for the purpose of resale through Consignee’s online and/or physical boutique. Consignee agrees to accept and attempt to sell such items on behalf of Consignor under the terms set forth in this Agreement.
2. Consigned Items
A detailed inventory of items accepted for consignment will be attached as Exhibit A. Consignee reserves the right to accept or reject any item at its sole discretion.
3. Authenticity and Ownership
Consignor warrants that all items are authentic, pre-owned (unless otherwise agreed), and lawfully owned by the Consignor. Consignee has the right to verify authenticity; any item determined to be counterfeit or stolen will be returned, destroyed, or turned over to authorities, at the sole discretion of the Consignee.
4. Term of Consignment
The standard consignment term is 90 days from the date items are listed for sale.At the end of the term, unsold items may be (check one):
___ Returned to the Consignor (at Consignor’s expense), or
___ Donated or liquidated, if not reclaimed within 15 days of notice.
5. Pricing and Sales
Consignee will determine listing prices based on market conditions, brand, and condition. Price reductions may be applied at the sole discretion of the Consignee to facilitate a sale. The Consignee agrees to act in good faith to obtain a fair market value for each item.
6. Commission and Payment
Upon sale of any item, Consignor will receive 60% of the final sale price, net of any discounts or promotions. Consignee retains the remaining 40% as commission. Payments will be issued to the Consignor within 30 days after the end of the calendar month in which the item is sold.
7. Loss, Damage, or Theft
While in Consignee’s possession, items will be handled with reasonable care. However, Consignee is not liable for loss, theft, or damage due to fire, natural disaster, or other force majeure events. Optional insurance coverage may be offered at additional cost upon request.
8. Withdrawal of Items
Consignor may request to withdraw items prior to the end of the consignment period with at least 7 days' written notice. Early withdrawal may be subject to a handling fee of $25 per item.
9. Indemnification
Consignor agrees to indemnify and hold harmless Consignee from any claims, damages, or liabilities related to ownership, authenticity, or the sale of the consigned items.
10. Termination
Either party may terminate this Agreement with 10 days' written notice. Upon termination, Consignor must collect any remaining unsold items within 15 days.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes will be resolved in the courts of Miami-Dade County.
12. Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, written or oral.
